TERMS AND CONDITIONS OF SALE
The sale is subject to the following terms and conditions. When submitting an offer and entering into the purchase agreement, the buyer must be familiar with and accept these terms and conditions.

- The buyer has reviewed the non-binding property information prior to entering into the purchase agreement and expressly accepts the contents thereof.

- Prior to entering into the purchase agreement, the buyer will be given the opportunity to have the property inspected by a recognised building inspection company in order to identify any structural defects, and/or to have the property inspected for the presence of asbestos-containing materials and/or have the soil examined for any contamination. The buyer has/has not made use of this opportunity.

- The property is sold on the basis of the “As is, Where is” principle.

- The seller is not aware of any asbestos-containing materials having been incorporated into the property or its installations, other than materials that were customary at the time the property was originally constructed. The seller is also not aware of any asbestos-containing materials having subsequently been used by other (previous) owners or occupants during any renovations and/or alterations. If asbestos-containing materials are removed, including asbestos-containing floor coverings, special measures must be taken pursuant to environmental legislation.
The buyer declares that they are aware of this and indemnifies the seller against all liability that may arise from the presence of any asbestos-containing substance in the property.

- If the value on which the buyer is liable to pay transfer tax can be reduced because the transfer takes place within six months of a previous transfer, pursuant to Article 13 of the Dutch Legal Transactions Tax Act (Wet op Belastingen van Rechtsverkeer), and the buyer therefore does not have to pay the transfer tax that would normally be due, the buyer shall pay the seller the difference between, on the one hand, the amount of transfer tax that would have been payable without such reduction and, on the other hand, the actual amount of transfer tax payable.

- If the legal transfer takes place later than the agreed date, the buyer will be charged interest at a rate of 8.5% of the purchase price per annum, calculated from the agreed date of legal transfer up to and including the actual date of legal transfer. This amount shall be paid simultaneously with the purchase price upon transfer of ownership. The compensation shall not be payable if the delay is attributable to circumstances within the seller’s sphere of responsibility.

- In principle, the buyer has the right to choose the notary. If the buyer chooses a notary’s office located more than 25 kilometres from the property being sold, the following costs may be charged to the buyer by the selling agent and its client:
1) Any additional notarial costs, for example the preparation of a power of attorney, which are charged to the seller.
2)Transportation costs and hourly fees.
These costs must be paid and settled at the notary specified in the purchase agreement on the day of the transfer of ownership.
